Club Terms
Provider: Spareya s. r. o. · Effective from: 8 July 2026 · Last updated: 13 October 2026

1. Introduction and nature of the relationship
1.1 These Club Terms (the "Club Terms") govern the use of the Spareya Service by sports clubs, sections, groups and other organised communities (the "Club") and supplement the Terms of Service. In the event of conflict, the Club Terms prevail in relation to Clubs; otherwise the Terms of Service apply. Capitalised terms have the meaning given in the Terms of Service.
1.2 B2B vs consumer relationship. If the Club acts within its business or professional activity (a registered club, a legal entity, a sole trader), this is a business-to-business (B2B) relationship. If the Club uses the Service outside a business activity (an informal group), it may be a consumer relationship; in that case mandatory consumer-protection provisions apply first and in the consumer's favour.
2. Defined terms
- Club — a sports club, section, group or other organised community with a club profile.
- Club administrator — an individual (18+) with an Account who registers and manages the Club on its behalf.
- Club profile — the public presentation of the Club (name, sport, city, description, announcements).
- Club announcement — Content published by the Club (recruitment, training, events).
- Youth work — any activity of the Club aimed at minors (children and young people under 18); see clause 7, the K2 regime.
3. Who may create and manage a Club; verification
3.1 Authority to act. A Club may be registered only by a Club administrator who declares and is responsible for being authorised to act on behalf of the Club.
3.2 Accuracy of data. Data about the Club must be truthful and must not mislead as to the Club's identity or focus. False data or impersonating another Club may lead to graduated measures (warning, restriction, suspension or closure of the profile).
3.3 Age. The Club administrator and all members with an Account must be 18 or older.
3.4 Club verification (K1). An ordinary Club is verified simply but unambiguously: by providing one piece of evidence of existence and authority (a website, a social-media profile, a registration/company number, or an email on the Club's own domain), the Club administrator having their own verified 18+ profile; a quick human check follows. Providing a company/registration number is optional (given informal clubs and different regimes across countries). The Provider may refuse or revoke verification where it has reasonable doubts.
3.5 Membership. Only a User with a verified profile may join a Club. A verified Club may post members-only training sessions even in a District or Area that has not yet been activated; only verified members of the Club may join them.
4. Club profile and Content
4.1 The Club is responsible for all Content it publishes. It is subject to the Community Rules and the Content rules in the Terms of Service (in particular the ban on unlawful and harmful Content). Club announcements are free and must not be hidden advertising; they must not be targeted at minors (Spareya is strictly 18+, children have no Account).
4.2 Licence. By publishing Content, the Club grants the Provider a non-exclusive, royalty-free licence to display it to the extent necessary to operate the Service, for the period the Content is in the Service.
4.3 Moderation. Club Content is subject to the "notice and action" mechanism and moderation under the Community Rules and the Terms of Service (including levels L1–L3 and a statement of reasons under the DSA).
4.4 Club announcements. A Club posts two kinds of announcements:
- A public announcement (recruitment) is also visible to people outside the Club, in particular on the Club card and in the list of announcements for people whose home is in the same District or Area. A public announcement from a verified Club is published immediately; a public announcement from an unverified Club is reviewed by our team before it is published. A public announcement stays up for no more than 30 days, and the Club may end it earlier. A Club with a free account may have no more than one active public announcement at a time. A public announcement notifies the Club's members, never non-members.
- A members-only announcement is visible only to the Club's members. It does not go through moderation before publication.
Anyone who can see either kind of announcement may report it; once reported, we assess it under clause 4.3.
5. Free of charge
The basic functions for Clubs — the Club profile, member recruitment and Club announcements — are free. Once we launch the Club competition (the seasonal leaderboard / district challenge), taking part in it will always be free, and the Provider will grant no competitive advantage for payment — ranking will be determined solely by real, cross-confirmed meetups.
6. The Club's liability for activities
6.1 Spareya brokers contact between people and Clubs; it is not the organiser of the Club's sports activities and is not responsible for their course. The Club is responsible for the safety, organisation and legal compliance of its activities (including any permits and insurance).
6.2 Limits on the exclusion of liability. The exclusion and limitation of the Provider's liability does not apply to the extent not permitted by mandatory law (in particular for injury to life and health, for intent or gross negligence and for the Provider's own fault). No exclusion of liability prohibited by consumer law applies against a Club that is a consumer.
7. Protection of young people ("parental loop") and the K2 safeguarding standard
7.1 Spareya does not allow accounts for minors. If a Club also involves children and young people, recruitment through the Club must not lead to minors creating accounts — it is directed solely at parents/legal guardians (the "parental loop"). Children never create an Account or provide their data in the App.
7.2 The Club must not publish photographs of minors or children's personal data. A breach is dealt with by the Provider as a priority and may lead to immediate closure of the profile.
7.3 Stricter K2 verification. A Club carrying out youth work must, before doing so, pass stricter K2 verification, which includes: (a) evidence of authority to carry out organised activity with minors; (b) evidence of good standing of the persons responsible for youth work (a criminal-record extract or national equivalent under the law of the country of operation); (c) acceptance of Spareya's safeguarding standard as a binding part of these Terms.
7.4 Rules of conduct. The Club and persons acting on its behalf must not directly approach or contact minors through the Service. In activities with children, the "one adult — one child that is not their own" (1:1) situation is prohibited, and the child is always accompanied by their own parent/guardian; the Club promptly reports to the Provider any suspicion of grooming or other endangerment of a child.
7.5 Sanction. A breach of clause 7 is a serious breach and may lead to immediate suspension and closure of the profile and to a report to the relevant authorities.
8. Duration and termination
The Club may close its profile at any time. In case of a breach of these Club Terms, the Terms of Service or the Community Rules, the Provider may respond with graduated measures (warning, restriction, suspension or closure of the profile), with reasonable justification and information on appeal under the Community Rules.
9. Personal data protection; roles
9.1 The Provider's processing of personal data is governed by the Privacy Policy.
9.2 Roles. In respect of the personal data the Club enters into the Service (in particular data of members and third parties), the Club acts as an independent controller within the meaning of the GDPR and is responsible for fulfilling its obligations (legal basis, information duty, data subjects' rights).
9.3 Declaration. The Club declares that it has a valid legal basis for providing the third-party data it enters into the Service and must not enter personal data without a legal basis (in particular no data or photographs of children — clause 7.2). The Club will indemnify the Provider for damage and penalties arising from a breach of this clause, to the extent permitted by law (against a Club that is a consumer, only to the extent of its fault and mandatory law).
10. Governing law and contact
These Club Terms are governed by Slovak law, subject to the mandatory rules of the Club's country of seat/residence and a consumer's mandatory rights (clause 1.2). Contact: support@spareya.eu.
