Terms of Service
Provider: Spareya s. r. o. · Effective from: 8 July 2026 · Last updated: 13 October 2026
1. Introductory provisions
1.1 These Terms of Service (the "Terms") govern the rights and obligations relating to the use of the Spareya platform, operated by:
Spareya s. r. o., Lermontovova 911/3, 811 05 Bratislava-Staré Mesto, Company ID (IČO) 57 718 768, registered in the Commercial Register of the Municipal Court Bratislava III, Section Sro, Insert No. 201128/B. Managing director: Marek Jankech. Contact: support@spareya.eu. Website: https://spareya.eu.
(the "Provider" or "we").
1.2 What the Service is. Spareya is a "find a sports partner" platform consisting of a mobile and web application (the "App") and the website spareya.eu (the "Website"); together, the "Service". The Service enables, in particular, finding sports partners, posting one-on-one (1:1) and group Meetups and signing up for them, showing places and Meetups on a map, chat, and creating and finding sports clubs and events.
1.3 Acceptance of the Terms. By creating an Account, joining the Waitlist or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, do not use the Service.
1.4 Consumer. If you use the Service as an individual outside the scope of your business activity, you are a consumer and enjoy special rights under consumer protection law; these rights are not affected by these Terms.
1.5 Consumers in the United Kingdom. If you are a consumer habitually resident in the UK, the choice of Slovak law and courts (clause 12) does not deprive you of the mandatory protection afforded by the law of England and Wales, Scotland or Northern Ireland (in particular the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013), and you may also bring claims before the courts of your place of residence.
1.6 Language and order of documents. These Terms, together with the Privacy Policy, the Community Rules and the Campaign Rules, form a single contractual framework. In the event of conflict, the Community Rules prevail on matters of conduct and the Privacy Policy prevails on matters of personal data.
2. Definitions

- User / you — an individual who is at least 18 years old and has an Account, or a visitor to the Website.
- Account — a user account in the App.
- Content — anything a User creates or uploads (chat messages, bio, club announcements, photos).
- Meetup — a sports meetup posted through the App, or a meetup a User has signed up for.
- Club — a sports club or section with a club profile.
- Waitlist / Campaign — the list of interested people / the "The Great Unlock" promotional campaign.
3. Age requirement (18+) and identity verification
3.1 Strictly 18+. The Service is intended solely for persons who are at least 18 years old. An Account may not be created or used by anyone under 18. By creating an Account you declare that you are at least 18.
3.2 No accounts for minors. No accounts exist or will be created for children or young people. Recruitment of younger athletes takes place solely through verified Clubs and is directed at parents; a minor will never gain access to the App.
3.3 Real-person and age verification. Before your first Meetup we use a short camera check, via the external provider Didit, to verify that you are a real, live person (no identity document). We verify the 18+ requirement through your year of birth at registration and, when there is a reason (e.g. an age of 18 to 20 in your Profile, a report or a moderator's request), also through an automated age estimate from your face; if the estimate is low, a person from our team decides. Verification may be a condition of access to selected functions. Temporarily: we will switch on camera verification through Didit before the first district or area unlocks; until then, no Meetups with people take place, the exception being training sessions for members of a verified Club only, where the Club knows its own members.
3.4 We do not store the photo or the video. From verification we do not store the photo, the video or the estimated age — we retain only the result ("verified" yes/no + date) and a record of how the verification went. See the Privacy Policy.
3.5 Limited functionality without verification. Until you complete verification, functions in your Account may be limited (e.g. being unable to post Meetups, sign up for them or contact others). The scope of functions is determined by the Provider and may change for security reasons.
3.6 Before a district or area is activated. During the Campaign, Meetups with people in a district or area start only after it is activated (normally within 3 business days of reaching the threshold). Even before activation, the My sport log, Clubs (including training sessions for members of a verified Club only), the map of sports venues, shops and events, and the list of coaches already work. The other parts of the Service remain in preview mode until activation. Details are set out in the Campaign Rules.
3.7 Family events and children accompanied by a parent. Some Meetups may be marked as family events. A User (parent/legal guardian) may bring their own minor child to such a Meetup. The child is throughout accompanied by and under the sole responsibility and supervision of the accompanying parent; the Provider does not assume supervision of the child. The child is not a User — no Account is created and no personal data about the child is processed. A child must never be left alone with anyone other than their parent/guardian. Organised programmes and youth recruitment are possible solely through verified Clubs.
4. Registration and Account
4.1 Creating an Account. Using the App requires creating an Account. On registration you must provide truthful, accurate and current data and keep it up to date.
4.2 One Account. Each User may hold at most one Account. Multiple accounts, accounts under another person's identity, or accounts used to circumvent a suspension/closure are prohibited.
4.3 Securing access. You are responsible for the confidentiality of your password and for activity under your Account. Report any suspected unauthorised access to support@spareya.eu.
4.4 Accuracy of data. Providing false data (in particular about identity, age or level) may lead to restriction, suspension or closure of the Account.
4.5 No transfer. The Account is non-transferable — you may not sell, rent or make it available to a third party.
5. Rules of use and User Content
5.1 Community Rules. By using the Service you undertake to comply with the Community Rules, which form an integral part of these Terms.
5.2 Prohibited unlawful and harmful Content. It is prohibited to create or spread Content that is, in particular, unlawful, hateful, threatening, harassing, deceptive, sexually explicit, promoting violence, or infringing the rights of third parties, or endangering the safety of others. Also prohibited are the unauthorised collection of others' data, spam, fraud and circumventing security and moderation mechanisms.
5.3 Licence to display Content. Content you create remains yours. By creating it you grant the Provider a non-exclusive, royalty-free licence, limited to the period the Content is in the Service, to store, display and make it available to the extent necessary to operate the Service (e.g. showing your bio to others, delivering messages). The licence does not permit using your Content for unrelated marketing without your separate consent. After Content is removed we may technically retain it to the extent necessary to comply with legal obligations and defend claims (e.g. during an ongoing report), in accordance with the Privacy Policy.
5.4 Moderation and "notice and action" (DSA). In line with the DSA we operate a mechanism to report unlawful Content or Content breaching the Community Rules. Every User can report Content or another User and can block another User. We assess reports through an escalation procedure (L1–L3). The single point of contact for users and authorities under the DSA is support@spareya.eu (SK + EN, not solely automated).
5.5 Moderation tools. To protect Users we use automatic detection of attempts to exchange contact details in chat; we plan to add automated AI content moderation later. These tools serve to flag content for human review — we do not make decisions with a legal or similarly significant effect solely by automated means (Article 22 GDPR). We will inform you of significant automated measures with a statement of reasons (in particular Article 17 DSA).
5.6 Right to remove Content and suspend an Account. We reserve the right to remove Content that breaches these Terms, the Community Rules or the law and, depending on the seriousness and repetition, to apply graduated measures: warning, restriction, suspension or closure of the Account. We will notify you of the measure and its reasons and give you the opportunity to object where required by law (in particular the DSA). Where there is an immediate safety risk we may act immediately and give reasons afterwards.
5.7 Recommender system (matchmaking). To suggest partners and Meetups we use a recommender system. The main parameters are matching/complementary sports, level, location (district or area) and mutual availability. For each suggestion we show the reasons for the match, so you understand why we are showing it to you (Article 27 DSA).
6. In-person Meetups and liability
6.1 Spareya is an intermediary, not an organiser. The Service serves solely to broker contact and enable arranging a Meetup. Meetups take place between Users. The Provider is not the organiser or a participant of any Meetup, provides no sports, coaching or supervisory services, and is not responsible for the course, safety or outcome of a Meetup.
6.2 Participation at your own risk. You take part in any sports activity and Meetup voluntarily and at your own responsibility and risk. Sport carries a risk of injury; you are responsible for assessing your fitness and the suitability of the activity.
6.3 Exclusion of liability for others' conduct. To the extent permitted by law, the Provider is not liable for the conduct, omissions, behaviour or Content of other Users, nor for damage or injury to health/property arising in connection with a Meetup or contact with another User. This does not affect liability that cannot be excluded under the law (in particular for intent, gross negligence and injury to life and health caused by the Provider's fault).
6.4 Safety recommendations. We recommend: hold the first Meetup in a public place; tell someone close to you where and when; do not share sensitive contact details prematurely; if someone behaves inappropriately, end the Meetup and report and block the User. In your Account you can voluntarily set an emergency contact. In case of immediate danger always call the emergency line 112 (or the national emergency line for your country).
6.5 The map does not show people. The map shows only places and Meetups, never the location of people. Neither a User's precise location nor the location of their device is collected or stored; what is stored as their home is a municipality (its centre point) and the district or area and approximate zone (about 5 × 5 km) derived from it. This is our binding promise (see the Privacy Policy).
7. The Service is free
Use of the Service is free for Users and Clubs. We take no payments and no function is locked behind a paywall.
8. Intellectual property rights
8.1 The Provider's rights. The Service as a whole — the software, source code, design, user interface, databases, texts, graphics, the "Spareya" trade mark and logo and the mascot — is protected by intellectual property rights and belongs to the Provider or its licensors.
8.2 Licence for the User. We grant you a non-exclusive, non-transferable and revocable right to use the Service for personal, non-commercial purposes in accordance with these Terms. This right does not include any transfer of ownership or other intellectual property rights.
8.3 Prohibitions. Without our prior written consent you may not, in particular, copy, modify, reverse-engineer or decompile the Service's software (except to the extent permitted by mandatory law), use the Spareya mark or logo, or use automated means (scraping, bots) to access the Service.
8.4 User Content. Your rights to your own Content are not affected by this clause; the licence is governed by clause 5.3.
9. Liability and warranties
9.1 Service "as is". The Service is provided "as is" and "as available". To the extent permitted by law we give no express or implied warranties that it will be error-free, uninterrupted, always available, or that it will meet your specific expectations (in particular that you will find a suitable partner). This does not affect a consumer's statutory rights in respect of defects.
9.2 Limitation of liability. To the extent permitted by law the Provider is not liable for indirect or consequential damage, lost profit, loss of data, or damage caused by the conduct of third parties or other Users. These limitations do not apply to liability that cannot be excluded under the law (in particular intent, gross negligence, injury to life and health) and do not affect a consumer's mandatory rights.
9.3 Availability. We make reasonable efforts to keep the Service available, but may restrict it temporarily for maintenance, updates, security or reasons beyond our control. The free nature of the Service does not create a right to a specific level of availability.
9.4 Force majeure. The Provider is not liable for failure to perform caused by force majeure (natural events, power/internet outages, third-party outages, cyberattacks and the like).
10. Duration and termination
10.1 Duration. The contract is concluded for an indefinite period and lasts while you have an Account or use the Service.
10.2 Deletion of the Account by the User. You may delete your Account at any time and without giving a reason, directly in the App or by request to support@spareya.eu. After deletion we will deal with your data in accordance with the Privacy Policy.
10.3 Suspension/closure by the Provider. In case of a breach of these Terms, the Community Rules or the law, or a threat to the safety of others, we may apply graduated measures depending on the seriousness and repetition (warning, restriction, suspension, closure). We will notify you of the reasons and give the opportunity to object to the extent required by law (in particular the DSA), except where the law or an immediate safety risk prevents it.
10.4 Effects of termination. On termination you lose access to the Account and the Content in it. Provisions that by their nature should survive (in particular clauses 8, 9 and 12) remain in force.
11. Changes to the Terms
11.1 We may change these Terms for reasonable reasons (in particular when functions, laws or operational procedures change). We will notify you of material changes in advance (in the App or by email) with reasonable notice. If you do not agree with a change, you may terminate the contract (delete your Account) before it takes effect. A consumer's mandatory rights are not affected.
12. Governing law and dispute resolution
12.1 Governing law. These Terms are governed by the law of the Slovak Republic. If you are a consumer, this choice does not deprive you of the protection afforded by the mandatory provisions of the law of your country of habitual residence in the EU.
12.2 Amicable resolution and ADR. We try to resolve disputes amicably first (support@spareya.eu). If you are a consumer and are not satisfied with how a complaint is handled, you have the right to turn to an alternative dispute resolution body; in Slovakia this is in particular the Slovak Trade Inspection (www.soi.sk).
12.3 Jurisdiction. The courts of the Slovak Republic have jurisdiction over disputes. This does not affect a consumer's right to bring proceedings before the courts of their place of habitual residence, nor their other mandatory rights.
13. Final provisions
13.1 Severability. If any provision becomes invalid or unenforceable, the remaining provisions stay in force; the invalid provision is replaced by one closest to the original intent.
13.2 Entire agreement. These Terms, together with the Privacy Policy, the Community Rules, the Cookie Policy and (for Campaign participants) the Campaign Rules, constitute the entire agreement on the use of the Service. The Provider's identification details are in the Legal Notice.
13.3 Contact. For questions about these Terms, contact us at support@spareya.eu.
13.4 Effect. These Terms take effect on 8 July 2026. The current version is always available in the Service.
